Company Information

These Terms of Service (“Terms”) govern the services provided by KM Auto Export Co., Ltd. (“KM Auto”, “we”, “us”).

By using our website, requesting quotations, placing orders, or instructing us to bid/purchase/export vehicles, you agree to these Terms.

Services

KM Auto provides Japanese vehicle sourcing and procurement support, auction bidding assistance, supplier purchase coordination, inspection coordination (where available), export documentation preparation, and international shipping arrangements.

Service availability may vary depending on vehicle type, destination, shipping line schedules, and regulatory requirements.

Quotations & Pricing

Vehicle pricing, freight rates, inland transport costs, inspection fees, and shipment schedules are subject to confirmation at the time of order.

Quotations may be estimates and may change due to auction results, exchange rates, shipping line changes, port fees, or regulatory requirements.

The official invoice issued by KM Auto represents the final commercial agreement for the transaction.

Customer Responsibilities

·         Provide accurate customer, consignee, and destination information.

·         Confirm import eligibility, emission rules, age limits, registration requirements, and taxes/duties in the destination country.

·         Respond promptly to requests for confirmation and documents.

·         Ensure funds are paid according to the Payment Security Policy and invoice instructions.

Auction Bidding & Purchase Authorization

If you request bidding, you authorize KM Auto to place bids on your behalf subject to your agreed limits and conditions.

Once a vehicle is won at auction or confirmed with a supplier, it may create binding obligations and fees. You understand that cancellation may be limited (see Refund & Cancellation Policy).

Compliance, Sanctions & Non-Diversion

Customers must confirm that vehicles will not be re-exported or diverted to restricted destinations or sanctioned entities.

KM Auto may request customer identification, end-user confirmation, and other information to verify compliance and prevent diversion.

KM Auto reserves the right to refuse, suspend, or terminate transactions where compliance risk exists.

Inspections, Condition, and AS-IS Sales

Unless otherwise agreed in writing, vehicles are sold for export on an AS-IS basis. Auction sheets and inspection reports are provided by third parties and may be subjective. See the Legal Disclaimer for additional details.

Shipping, Documentation, and Risk

Shipping schedules are estimates only. Delays may occur due to shipping lines, port congestion, customs processes, weather, labor actions, or government procedures.

KM Auto will prepare export documents based on the transaction data and instructions provided. Customers must confirm consignee details and destination information before document finalization.

Intellectual Property

Website content, logos, photographs (except third-party content), and branding used by KM Auto are protected by applicable intellectual property laws. You may not copy, republish, or use our materials for commercial purposes without written permission.

Limitation of Liability

To the extent permitted by law, KM Auto will not be liable for indirect, incidental, special, consequential, or punitive damages.

Where liability cannot be excluded, KM Auto’s total liability will be limited to the amounts actually paid to KM Auto for the relevant vehicle/service.

Indemnity

You agree to indemnify and hold KM Auto harmless from claims, losses, and expenses arising from your breach of these Terms, misuse of services, inaccurate instructions, or violations of destination-country import laws.

Governing Law & Dispute Resolution

These Terms are governed by the laws of Japan.

If a dispute cannot be resolved amicably, the parties agree to the exclusive jurisdiction of the competent courts in Japan (unless mandatory law provides otherwise).

Updates to These Terms

KM Auto may update these Terms from time to time to reflect legal, operational, or service changes. The latest version will be made available through our official channels.
